The ACAS Code of Practice
The ACAS Code on Disciplinary and Grievance Procedures sets the minimum standard every UK employer must follow. Failure to follow it can uplift any tribunal award by up to 25%.
In short:
- Investigate fairly before deciding to invite you to a hearing.
- Tell you the allegations in writing, with enough detail to prepare.
- Hold a hearing where you can respond.
- Allow you to be accompanied by a colleague or trade union representative.
- Decide and tell you in writing.
- Allow you to appeal.
Possible outcomes
- No further action.
- Informal action / counselling.
- Written warning (typically 6-12 months on file).
- Final written warning.
- Dismissal (in serious cases or after prior warnings).
During the process
You can ask for the evidence against you, request reasonable adjustments if you are disabled, and request that witnesses are interviewed. Take notes; ask for minutes of every meeting.
If you are signed off sick during the process, the employer should usually adjourn — but they can continue if the delay would be unreasonable.
After dismissal
If you believe the dismissal was unfair, start ACAS Early Conciliation within 3 months less one day of the effective date of termination.
